一、依據勞動部114年12月30日勞動發攬專字第1140521128D號及同年月31日同字第1140521131B號2函辦理。

二、勞動部自111年4月30日開放取得我國副學士以上學位之僑外生,符合薪資條件資格及技術條件,可從事製造業、屠宰業、營造業、農業及長照等中階技 「術工作,113年8月28日起再開放符合薪資條件資格及技術條件者,可從事旅宿服務工作(備註:皆屬就業服務法第四十六條第一項第十一款規定專案核定之工作),相關規範原訂於「外國人從事就業服務法第四十六條第一項第八款至第十一款工作資格及審查標準」(下稱審查標準)及「雇主聘僱外國人許可及管理辦法」(下稱雇聘辦法)。

三、勞動部將原「中階技術人力」名稱修正為「外國技術人力」,並整合審查標準及雇聘辦法有關其工作資格、申請許可及聘僱管理等規定,訂定「外國技術人力工作資格及許可管理辦法」,並自公布日生效。

四、其中有關僑生留臺就業部分,除原開放副學士以上畢業僑外生從事之中階技術工作類別及旅宿服務工作外,新增「多元陪伴照顧服務技術工作」以及 「商港碼頭貨物裝卸集散工作」(第6條及第7條),至從事各工作資格條件,則另以114年12月31日同字第1140521131A號公告之。

1. This announcement is issued in accordance with two official letters from the Ministry of Labor:
   Letter No. 1140521128D dated December 30, 2025, and Letter No. 1140521131B dated December 31, 2025.

2. Since April 30, 2022, the Ministry of Labor has allowed overseas Chinese and foreign students who have obtained an associate degree or higher in Taiwan, and who meet the required salary and technical qualifications, to engage in intermediate-level technical work in industries such as manufacturing, slaughtering, construction, agriculture, and long-term care.
   Furthermore, effective August 28, 2024, eligible individuals who meet the salary and technical requirements have also been permitted to work in the hotel and accommodation services sector.
   (Note: All of the above positions fall under project-based employment approved pursuant to Article 46, Paragraph 1, Subparagraph 11 of the Employment Service Act.)
   Previously, the relevant regulations were governed by the “Qualification and Review Standards for Foreigners Engaging in Work under Article 46, Paragraph 1, Subparagraphs 8 to 11 of the Employment Service Act” (hereinafter referred to as the Review Standards) and the “Regulations on the Permission and Administration of the Employment of Foreign Workers” (hereinafter referred to as the Employment Regulations).

Explanatory Notes

3. The Ministry of Labor has renamed the term “Intermediate-Level Technical Manpower” to “Foreign Technical Professionals” and consolidated provisions related to work qualifications, permit applications, and employment management from the Review Standards and the Employment Regulations. As a result, the “Regulations on Work Qualifications and Permit Management for Foreign Technical Professionals” have been formally established and took effect on the date of promulgation.

4. With respect to overseas Chinese students seeking employment in Taiwan, in addition to the previously approved categories of intermediate-level technical work and hotel/accommodation services for associate degree holders or above, two new categories have been added:

   • Diversified Companion Care Service Technical Work

   • Cargo Handling and Distribution Operations at Commercial Ports
     (Articles 6 and 7)
     The specific qualification requirements for each job category are separately announced under Ministry of Labor Letter No. 1140521131A dated December 31, 2025.

5.
